Online Liability Waiver

LIABILITY WAIVER AND RELEASE OF LIABILITY
Online Yoga Classes offered by Christopher Denault and Emu Enterprises LLC DBA Golden by Carrlee & Chris

Please read this Liability Waiver and Release of Liability (“Agreement”) carefully before participating in any online yoga classes, videos, live sessions, workshops, or related activities offered by Christopher Denault and/or Emu Enterprises LLC DBA Golden by Carrlee & Chris (collectively, the “Instructor” or “Released Parties”). By submitting this form (including by checking “I Agree”), you acknowledge that you have read, understood, and agree to be bound by its terms.

1. DESCRIPTION OF ACTIVITIES I am voluntarily participating in online yoga classes, instructional videos, live-streamed sessions, workshops, challenges, and/or other wellness, movement, breathing, meditation, or related activities (collectively, the “Activities”) offered by Christopher Denault and/or Emu Enterprises LLC DBA Golden by Carrlee & Chris, whether accessed via website, video platform, app, social media, Zoom, or any other digital medium.

2. ACKNOWLEDGMENT OF HEALTH AND FITNESS I represent and warrant that: • I am in adequate physical and mental health to participate in the Activities. • I have no medical condition that would prevent my safe participation (or I have been cleared by my physician). • It is my sole responsibility to consult a licensed physician before beginning these Activities. • The Instructor is not a medical professional. These Activities are not a substitute for medical advice or treatment. • I will stop or modify my practice immediately if I experience any pain, dizziness, or discomfort. • The Instructor reserves the right to refuse my participation for any reason.

3. ASSUMPTION OF RISK I fully understand that participation involves inherent risks of injury (including muscle strains, joint injuries, falls, cardiovascular events, aggravation of pre-existing conditions, and risks unique to practicing at home without in-person supervision). I knowingly and voluntarily assume all such risks, even if arising from the negligence of the Instructor or any Released Party, and assume full responsibility for creating a safe practice space.

4. RELEASE OF LIABILITY AND WAIVER OF CLAIMS In consideration of being permitted to participate, I (on behalf of myself, my heirs, and assigns) hereby irrevocably: (a) Release, waive, discharge, and covenant not to sue Christopher Denault, Emu Enterprises LLC, Golden by Carrlee & Chris, and any of their owners, officers, agents, employees, contractors, or affiliates (the “Released Parties”) from any and all Claims (including personal injury, death, or property damage) arising from my participation, even if caused by negligence. (b) Agree to indemnify and hold harmless each Released Party from any Claims brought by me or others related to my participation.

This release is intended to be as broad as permitted under Florida law.

5. ONLINE PARTICIPATION ACKNOWLEDGMENTS • Online instruction cannot provide the same form correction or immediate assistance as in-person classes. • I am solely responsible for a safe practice space. • I will use modifications and rest as needed. • Technical issues create no liability for the Instructor. • I will not share or redistribute paid content without permission.

6. MEDIA RELEASE (OPTIONAL) I consent to the use of my likeness, name, or voice if I appear in any live recordings or screenshots used for educational or promotional purposes. I may opt out by notifying the Instructor in writing before live sessions.

7. GOVERNING LAW This Agreement is governed by the laws of the State of Florida. Any disputes shall be brought exclusively in Monroe County or Miami-Dade County, Florida. Electronic submission of this form (name + email + checking “I Agree”) constitutes my legal electronic signature.

8. ACKNOWLEDGMENT I HAVE CAREFULLY READ THIS AGREEMENT. I FULLY UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. BY SUBMITTING THIS FORM I AGREE VOLUNTARILY AND INTEND THIS TO BE A COMPLETE RELEASE OF ALL LIABILITY TO THE MAXIMUM EXTENT ALLOWED BY LAW.
